The so called story does not say who is supposed to have said this, so we don't know if it is true or just the result of some "reporter's" delirium tremens. Proper newspaper reporters almost always ask the other side for a comment.

The youth worker says the owner of the donkey has asked for it to comply with council and insurance company requirements. No mention of the so called H&S Bosses, who are fictional.
In any case it seems a good idea to me, if the kid fell off and got brain damage the nativity would be ruined and you would all be asking why it wasn't wearing a helmet. Soft dry sand isn't the only thing the kid might fall on.
